Terms and Conditions for LimitKid

Welcome to LimitKid!
These Terms of Service ("Terms") govern your use of the LimitKid web application at https://limitkid.top (the "Service"). By creating an account and using our Service, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree to these Terms, do not use the Service.
1. Description of Service
LimitKid is a family money management application designed to help parents and guardians teach children (ages 6-17) about financial literacy. The Service allows you to:
- Track children's income and expenses
- Set and monitor savings goals
- Create family spaces for multi-guardian collaboration
- View spending patterns and receive insights
- Manage allowances and teach financial concepts
LimitKid is intended for use by adults (parents, guardians) to manage financial education for children under their care.
2. Account Registration and Eligibility
2.1 Age Requirement
You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old.
2.2 Account Information
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
2.3 Account Types
We offer two account types:
- Free Plan: Basic features for one child
- Pro Plan: Advanced features including multi-guardian permissions, AI categorization, bank sync (when available), and support for multiple children
3. Subscription and Payment Terms
3.1 Subscription Plans
Pro Plan subscriptions are billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fee.
3.2 Free Trial
We offer a 14-day free trial for the Pro Plan. No credit card is required to start the trial. You can cancel anytime during the trial period without being charged.
3.3 Billing and Renewal
- Subscriptions automatically renew at the end of each billing period unless canceled
- You will be charged at the beginning of each billing period
- Subscription fees are non-refundable except as required by law or as specified in Section 3.5
3.4 Price Changes
We reserve the right to change subscription prices. We will notify you at least 30 days before any price change takes effect. Your continued use of the Service after the price change constitutes acceptance of the new price.
3.5 Refund Policy
We offer a full refund within 14 days of your first subscription payment if you are not satisfied with the Pro Plan. After 14 days, subscription fees are non-refundable. To request a refund, contact us at bartzalewskidev@gmail.com.
3.6 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- You will retain access to Pro features until the end of your current billing period
- No refund will be provided for the remaining time in your billing period
- Your account will automatically downgrade to the Free Plan at the end of the billing period
3.7 Payment Processing
Payments are processed by Stripe, a third-party payment processor. By providing payment information, you agree to Stripe's terms and conditions.
4. User Responsibilities and Acceptable Use
4.1 Your Responsibilities
You agree to:
- Use the Service only for lawful purposes and in accordance with these Terms
- Use the Service to manage financial data for children under your legal guardianship
- Ensure the accuracy of financial data you enter
- Not use the Service to track financial information for children without proper parental authority
- Not attempt to gain unauthorized access to the Service or other users' accounts
- Not interfere with or disrupt the Service or servers
4.2 Prohibited Activities
You may not:
- Use the Service for any illegal purpose
- Share your account with others
- Attempt to reverse engineer, decompile, or hack the Service
- Upload viruses, malware, or malicious code
- Scrape, spider, or crawl the Service
- Use the Service to harass, abuse, or harm another person
- Impersonate another person or entity
- Violate any applicable laws or regulations
5. Data and Privacy
5.1 Your Data
You retain ownership of all data you enter into the Service, including financial information about your children. We do not claim ownership of your data.
5.2 Our Use of Data
We use your data solely to provide and improve the Service. We do not sell your data to third parties. For details, see our Privacy Policy at https://limitkid.top/privacy-policy.
5.3 Data Backup
While we maintain regular backups, you are responsible for maintaining your own backup copies of important data. We are not liable for any loss of data.
5.4 Data Deletion
You may delete your account and all associated data at any time through your account settings. Upon deletion, we will permanently remove your data within 30 days.
6. Family Spaces and Multi-Guardian Access
6.1 Inviting Guardians
You may invite other guardians (co-parents, grandparents, etc.) to access family spaces. By inviting a guardian:
- You grant them access to the financial data for that child
- You represent that you have the authority to share this information
- You are responsible for managing guardian permissions (Pro Plan feature)
6.2 Guardian Responsibilities
All guardians with access to a family space must comply with these Terms and use the data responsibly.
6.3 Removing Guardians
You may remove a guardian's access at any time through family space settings.
7. Intellectual Property Rights
7.1 Our Property
The Service, including all content, features, functionality, software, designs, text, graphics, logos, and other materials, is owned by LimitKid and protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.
7.3 Restrictions
You may not:
- Copy, modify, or create derivative works of the Service
- Rent, lease, sell, or sublicense access to the Service
- Remove or alter any copyright, trademark, or other proprietary notices
8. Third-Party Services
The Service integrates with third-party services including:
- Stripe for payment processing
- Google for authentication
- MongoDB Atlas for data storage
Your use of these services is subject to their respective terms and conditions. We are not responsible for the actions or policies of these third parties.
9. Service Availability and Modifications
9.1 Availability
We strive to provide reliable service but do not guarantee uninterrupted or error-free access. The Service may be unavailable due to:
- Scheduled maintenance
- Technical issues
- Factors beyond our control
9.2 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time
- Add or remove features
- Change how the Service operates
We will provide reasonable notice of significant changes when possible.
10. Disclaimers and Limitations of Liability
10.1 "AS IS" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Financial Advice
LimitKid is an educational tool for teaching children about money management. We do not provide financial advice, tax advice, or investment recommendations. The Service should not be used as a substitute for professional financial advice.
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMITKID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless LimitKid and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any data you submit to the Service
12. Term and Termination
12.1 Term
These Terms remain in effect while you use the Service.
12.2 Termination by You
You may terminate your account at any time by deleting your account through account settings.
12.3 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- We are required to do so by law
- We discontinue the Service
12.4 Effect of Termination
Upon termination:
- Your access to the Service will end immediately
- You will lose access to all data in your account
- We will delete your data in accordance with our Privacy Policy
- Sections that by their nature should survive termination will survive
13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
13.2 Disputes
Any dispute arising out of or related to these Terms or the Service shall be resolved in the courts of France.
13.3 Informal Resolution
Before filing any formal claim, you agree to contact us at bartzalewskidev@gmail.com to attempt to resolve the dispute informally.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LimitKid regarding the Service.
14.2 Amendments
We may update these Terms from time to time. When we make changes:
- We will update the "Last Updated" date
- We will notify you via email or through the Service
- Your continued use of the Service after changes become effective constitutes acceptance
14.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.4 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
14.5 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
14.6 No Agency
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and LimitKid.
